Arizona law provides for alcohol and drug related DUI offenses, including two levels of DUI offenses. To convict you of DUI, the state must prove that you were in actual physical control of the vehicle at the time. If proven, you can be convicted on the basis of your blood alcohol level alone, even if evidence shows that you were not driving recklessly or erratically. The equipment used to determine blood alcohol levels is not always100% accurate, and its vulnerability can sometimes serve as the basis of a successful defense. We can identify if the equipment was negligently maintained or otherwise suspect at the time of your BAC testing, possible resulting in charges against you being dropped. Related DUI crimes, such as aggravated assault with a vehicle and vehicular homicide, are very serious crimes in Arizona. Aggravated assault with a vehicle is a dangerous offense-an offense involving a weapon-with the vehicle considered to be the weapon, and thus carries additional penalties and consequences.
